Kiir Moves To Clear Legal Hurdles Ahead Of December Poll

South Sudan has entered a significant new phase of its political transition after President Salva Kiir dissolved the country’s transitional government and signed amendments to electoral laws that remove some of the conditions that had delayed national elections.

The move, announced on September 22, 2026, comes as South Sudan prepares for elections scheduled for December 22, after years of postponements.

Reuters reported that the amendments remove previous requirements for completion of a permanent constitution and a national census before elections could proceed.

From Independence To An Unfinished Transition

South Sudan became independent in 2011 but has struggled to establish a stable political order.

The country descended into civil war in 2013 and again experienced major conflict in 2016. A peace process eventually produced the Revitalised Transitional Government of National Unity.

However, elections that were expected to mark the end of the transitional arrangement were repeatedly delayed.

The latest changes are intended to remove some of the legal and administrative obstacles that have stood in the way of a national vote.

A Caretaker Government Expected

With the transitional government dissolved, attention is turning to the composition and responsibilities of the caretaker administration.

The EastAfrican reported that President Kiir is expected to establish a caretaker government as the country moves towards the planned December election.

The transition is being closely watched because South Sudan’s political institutions remain relatively young and the country has a history of political and armed conflict.

The planned election would be an important test for South Sudan’s political institutions.

At the same time, Al Jazeera reported that the dissolution has prompted concerns about the concentration of executive authority during the transition.

Developments in South Sudan have direct implications for East Africa.

Uganda shares a long border with South Sudan and has extensive economic, security and people-to-people links with its northern neighbour.

Political stability in South Sudan matters for cross-border trade, transport, refugee movements and regional security.

A credible electoral process could therefore have consequences extending beyond Juba.

The coming months will determine whether South Sudan can move from an extended transitional arrangement towards a more permanent constitutional and electoral system.

The immediate focus will be on the caretaker government, preparations for the vote and the ability of political actors to maintain the peace as the election approaches.

For a country that has spent much of its independent history struggling with conflict and political transition, the December timetable represents a significant moment.
