The ongoing treason trial involving veteran opposition leader Dr. Kizza Besigye and his co-accused Hajj Obeid Lutale Kamulegeya has taken a dramatic turn after the presiding judge, Justice Emmanuel Baguma, declined requests to recuse himself despite allegations that his impartiality may reasonably be questioned.

The controversy has been amplified by the emergence of a 2025 State House letter purportedly directing the UPDF Engineering Brigade to construct a residence for Justice Baguma following security concerns reportedly linked to proceedings involving Dr. Besigye.

The development has reignited debate over judicial independence, public confidence in Uganda’s justice system, and the fairness of one of the country’s most politically sensitive trials.

Judge Rejects Calls for Recusal

Lawyers representing Besigye and Lutale argued that Justice Baguma should step aside from the case, citing concerns that his previous decisions and surrounding circumstances had created a perception of bias.

However, the judge rejected the application and maintained that he was capable of handling the proceedings fairly and impartially. The ruling cleared the way for the trial to continue before the same judicial officer.

The defence maintains that public confidence in the judiciary requires not only actual impartiality but also the appearance of impartiality.

The Letter at the Centre of the Storm

A document dated July 3, 2025, bearing State House letterhead and attributed to President Yoweri Kaguta Museveni, has circulated widely on social media.

The letter is addressed to Brig. Gen. Cyrus Besigye Bekunda, Commander of the UPDF Engineers Brigade, and references the construction of a residential house for Justice Emmanuel Baguma.

According to the document, the President was responding to reported security concerns arising from proceedings involving Dr. Kizza Besigye and directed the military engineering brigade to engage the judge and construct a secure residence consistent with his security requirements.

The authenticity and legal implications of the document have become a subject of intense public debate, particularly because Justice Baguma is presiding over a politically charged case involving one of President Museveni’s longest-serving political opponents.

Why the Defence Questions Impartiality

Legal analysts note that judicial officers are expected to avoid situations that may create a reasonable apprehension of bias.

The defence team argues that where a judge is perceived to have received significant benefits or support from parties connected to the executive branch, questions naturally arise about whether an objective observer would view the proceedings as fair.

Supporters of Besigye contend that the State House letter strengthens concerns already raised regarding earlier rulings in the case, including decisions on bail and trial management.

Judiciary officials, however, have consistently maintained that judicial officers take an oath to administer justice without fear or favour and that allegations of bias must be supported by credible legal evidence rather than speculation.

The case against Besigye and Lutale has attracted significant scrutiny from local and international observers since the pair were arrested in late 2024 and subsequently charged with treason-related offences. Legal experts argue that courts derive their authority not merely from legal powers but also from public confidence that judges are independent from political influence.

As the trial proceeds, attention is likely to remain focused not only on the evidence presented against Besigye and Lutale but also on whether the judiciary can convincingly demonstrate its independence in a matter carrying enormous political significance.
