In a landmark decision on January 31, 2025, Uganda’s Supreme Court declared the trial of civilians in military courts unconstitutional, mandating an immediate cessation of such proceedings. This ruling has been met with widespread acclaim, notably from Mr. Frank Bulira Kabinga, President of the Uganda Democratic Organisation (UFDO), who lauded the judgment as a pivotal step toward upholding justice and human rights in the nation.

Mr. Kabinga emphasized that the government’s prior practice of prosecuting civilians in military courts was a veiled strategy to suppress political dissent. He highlighted the cases of prominent opposition figures such as Dr. Kizza Besigye, Haji Obeid Lutale, and human rights lawyer Eron Kiiza, who were subjected to military trials on charges perceived as politically motivated. Dr. Besigye, a long-standing critic of President Yoweri Museveni, faced multiple charges in the General Court Martial, including offenses related to firearms and security, some carrying the death penalty. Similarly, Eron Kiiza was arrested and reportedly tortured by soldiers at a military court, leading to his conviction and imprisonment under contentious circumstances.

Mr. Kabinga asserted that these military tribunals lacked the impartiality and legal competence required for fair trials, as their members are not equipped to handle criminal cases involving civilians. He argued that such courts should be confined to disciplinary matters within the military, a stance now affirmed by the Supreme Court’s ruling.

In light of the judgment, Mr. Kabinga called upon the government to promptly comply with the court’s directives. He urged the immediate transfer of all ongoing cases involving civilians from military courts to civilian judicial systems, ensuring that justice is administered fairly and transparently. He also advocated for the release of individuals like Dr. Besigye and Mr. Kiiza, who have been detained under what he described as unjust and unconstitutional proceedings.
